Class B Misdemeanor Range of Punishment - Texas Penal Code

§ 12.22. CLASS B MISDEMEANOR. 

An individual adjudged guilty of a Class B misdemeanor shall be punished by:

            (1) a fine not to exceed $2,000;

            (2) confinement in jail for a term not to exceed 180 days; or

            (3) both such fine and confinement.

I have a friend, who is 18, who got in trouble for theft over 50 dollars: a class b. She went to jail and had to post bail of 165. She has yet to receive arraingmnet or a court date. What is the common punishment for such a case? I realize that it is subjective to the judge and the case, but on average?

I was driving from kansas city mo to san antonio with my sister in her car.I was driving when we got to austin texas I was speeding when I passed a car using my blinker and was pulled over and arrested for reckless driving and charged with a class b misdemeanor reckless driving. My brother is in a similar situation as Tasha's friend. His offense was committed in August but has yet to receive a court date. He posted bond via a bail bondsman paying $875 of a $2000 bond. When should we expect a court date? Who do we contact for more info?

He set an air horn off in my ear twice within seconds of each other resulting in me having to go to the doctor the next day. The police officer on the scene did not arrest him. A different officer said he would have arrested him had he been the responding officer. Is this a class B misdemeanor?

I was arrested for theft over $50, a class B misdemeanor, I have a clean record and not even any traffic violations. My mother paid $250 of a $500 bond. I spent 12 hrs on Memorial Day and have court the following Monday. What should I expect my punishment to be? I was told a possible fine, 2 yrs prob. and community service. Is it possible for me to have to go back to jail?

One of my friends living in Dallas Texas was arrested for shoplifting (estmated cost of items $350) for the first time in her life , she has a clean record. I arranged with a lawyer to release her he charged me 750 dollars. I need to know what are the $750 for and whether if she needs a lawyer or not. The lawyer wrote the bond himself. Is there any way to got the case dismissed and to keep her clean record.

I was helping my brothers friend out by letting her and her son stay with me and my husbin. My husbinand I seperated. Just before leaving the house I allowed her to pawn some things for me. A few days latter I gave her money to take the things out and return them to my home until my husbin and I could work though our problems.My husbin stayed out of town alot. She told me the things were returned to the house. When I returned to my home I descovered that she had stolen everything she could get her hands on, including my car. I made a report but left out the fact that I allowed her to first pawn the items.Some of the items were returned to me. But then I was arrested for making a false statement to the police. They said I knowingly left out the fact that she had my permission to pawn them in the first place, and that she had never taken the Items out of pawn.I am now charged with a Class B misdaminner and do in Texas next month. I left Texas with my children because of an abusive situation. What do I do? I can not afford an attorny. I can barely afford to get there.Do I just pled guilty?

my ex has had an extensive criminal history and is now charged with 9 counts of theft by check (class b). He failed to appear in court for this recently also. I want to know what the length of stay in jail is for this. This is the 3rd time he's been put on a payment plan for these hot checks and the 3rd time he's failed to pay. I went shopping in a wal-mart one day about 6mnths ago and while we were there we ran into an old acquaintance and walked around visiting while we shopped. Come to find out she had been stealing before we even showed up and we had no idea. Well we all paid for our things and she paid for a few things and as we were walking out we were all stopped and walked back through wal-mart. Long story short she stole over $300 worth of stuff and my friend and I were charged along with her because she would not take up for us. They called us her look outs! We had no idea!!! Now 6mnts later I have a court date and I don't know what to go in there and say. I need help! I can't afford a lawyer but I would like a little advice.....

I am 16, and I live in dallas area. I was driving around an area of grass below a powerline at night and a neighbor called the police with my license plate. The police contacted my parents and were convinced that they could press charges. I did not destroy anything, all I did was drive on the grass instead of the alley. I am 21y/o a permanent resident of US and had a clean record prior to this misdemeanor. Last April 18, i was arrested for shoplifting @ a local dept store w/ over $150 of worth of items. I served a couple of hours in jail and was released the next day with a $500 bail. my parents paid $140 for a bond and is now waiting for court in a few weeks. I do not want to have the probation filed out on me for 12 months, but at the same time, im afraid if i serve time for it my record would carry this forever. cant there be another way to resolve this?like say apart from serving time, i could attend classes and work community service for it as well?

Is there any way to have a DWI expunged from my record? It was my first offense, and will greatly effect my career. Isn't there a way I can pay for this crime without losing my income? I have a child to support, and without a job I don't know how I will be able to pay my probation fees, fines, court costs, and support my daughter. I know I should have thought of that before I drove, but I honestly thought I was able to drive safely. There was no accident involved, and I was only a few miles from my home when I was stopped by a policeman for swerving...there was a dead skunk on the road that I was trying to avoid. Maybe I don't deserve a chance to keep my job, but I thought I would ask. Thanks.

Actually he took the rap for his mom boyfriend marjuana because he stole the car from him when he parked not knowing it was in the car when stopped by an officer. For all of you asking "(example) happened, what will happen to me?" The most truthful answer, as unhelpful as it is, is "it depends". For example, the gentleman accused of reckless driving: if you get to court and the cop doesn't show up at all, the judge is having a good day, you're very polite and respectful and you're in a suit and tie, odds are you will get less punishment than if you show up in a heavy metal T-shirt, call the judge "dude", and the cop has video evidence of you driving like a maniacal idiot. It all depends on what happens in court. If you want your best chance at lesser penalties, GET A LAWYER.

My husband is being charged with 2 counts of burglary of a vehicle. I believe they are considered class b misdemeanors. The punishment for that ranges from fines not to exceed $2,000.00 and confinement not to exceed 180 days. My questions are..... If convicted would he serve up to 6 months for each offense, equalling up to a year for both? Or, 6 months total for both offenses? Second..... Does a prior criminal history effect the outcome of any sentence he could receive? Meaning, could he serve more time than the standard punishment based on his criminal past? I would really appreciate any help in this matter. My husband has been in jail for nearly 2 days now, and he hasn't spoken with anyone, or been told anything about his case. Anyone who's asking "what's the typical penalty" or "what's going to happen in court", you're not going to want to hear this, but there is no such thing. It all depends on the judge's mood and politics, how the DA wants to prosecute this, etc. Your best bet is to talk to the DA and see what they want to do, if they want to cut you some slack. If you come in and talk to them like reasonable people they'll usually work with you; it's a hassle to take you to court. But if your offense was egregious, you've got a history of that, you're pushy, etc. those things will not help.

My husband got pulled over when he was driving with a suspended license. It was suspnded for DUI and he served time and has done all the processes and never was dirty and never missed his court dates. Actually the only reason he is still on the books is due to fees and fines that have to be paid b4 he can be released. What might the bond be to get him out? I was arrested and it was my first time ever. I have a court date scheduled 3 months from now. I have practically no money and I'm so scared I will go to jail. I was told not to plead guilty and to plead no contest? The store wants to charge me a lot of money for the civil part and said they will sue me if I dont pay it in 14 days. People in jail said not to pay the civil part because I returned all the items and they cant sue me if I plead no contest...but they made me sign something...it's not that I'm trying to not pay, it's that I don't have the money.

I live in the st.louis Missouri. Last weak, I was caught by Macy's while shoplifting item worth of $322. They called the police and i was sent to sub station. The police gave me the court date which is after 1 month and paper say that i have petty larcency. This is my first time offence. My mom decided to leave my dad, she went home to Texas to a house they share with my sister. She was removing her personal belongings when the guy who feeds the animals arrived and parked directly behind her on private property and called my dad. My mom went to leave and he refused to move his car. She ended up brushing it and drove off. At the request of my dad he called the cops and reported hit and run. At the same time my dad and sis called the cops and stated my mom was breaking and entry and stealing all their stuff (please note she has key to house). My mom has lived in that house since 1999. My dad and Mom bought it for my sis so that she would have a house when they passed away. The stuff she took was her personal belongings. Now my sis and Father are trying to convince the cops she is insane. My mom is neither insane or criminal (never had a speeding ticket). SHe simply wanted her things and away from those people after years and years of abuse. Can somebody offer me some thoughts as to where she stands and what she can do to fight these demons. She is a housewife and the only money she has is her social security check which is not very much because she was a housewife most of her life. She is 72 years old.

I have been working in the criminal justice field for years more recently as security officer, caseworker etc. I recently applied for position a prison guard for the state of Texas. I was denied employment due to background investigation. I recently check my background and found I had a deferred adjudication on a fictitious tag back in 1995. The person who own the vehicle was arrested for other charges but I was the driver while she was with me. I appeared in court twice. The second time, the attorney for the prosecution offered me deferred adjudication for one year and that it would not appear on my record. The arresting officer did not appear so in order to move on I took the plea deal. How do I go about removing this blight from my record?

My husband is in the process of getting his license back. We have paid 1500ish so far. Then he was picked up for failure to complete a full stop at a stop light. Two weeks before that he was stopped and served 7 days in jail for that offense. So he is facing a DWLS w/P C. We have still been paying on his suspension through all of this. I was pulled over beceause the officer said that i didnt have any insurance after running my drivers liscense he realized that it was not valid. i have been charged with a class b mist. for drining without a liscense and with no financial responibility. The atty said he is aiming to get the offense lowered from class b to class c. I'm 19 years old and this is my first offense. I am currently on probation for a class b misdemeanor, theft 50-500, I have paid all my court fees, bondsman, probation fees, however my probation is over and I have not completed my community service hours, approx a 1/4 actually, I know it is my fault but what can happen when the warrant has been issued? My daughter is 19 and has been charged with a class b misdermeanor for theft under $500. She has a clean record. What can she expect after she turns herself in and should she get a lawyer?

you can all expect to be either fined up to $2000, put in jail for a short term (1-3 months), or both.

My 29 year old daughter had been in a bad, abusive marriage for 9-1/2 years. Her soon to be ex husband had held her at gun point on more than one occassion we've since found out, and out of fear, when her 6 year old daughter told her about daddy "touching her", she did not contact the authorities. She confronted the husband, he denied it. It happened again, she confronted him, he left and went to his dads house. The dad asked her if she was really accusing him of this and she said yes. Finally the little girl told a 3rd party and it all came into the public light. Daddy was arrested for the crime. Mom was arrested for failure to report. After 6 weeks of investigations, CPS allowed the mother to be back with the children, due to the fact that they knew she'd been abused and battered and was in fear of retaliation from her husband if she told on him. She has a clean record except for this now. Any chance the courts will see her dilemma and drop the charges?

I got arrested in another county from where I live for driving on a suspended license. I had tickets for it previouse but never arrested. I was charged with a class B misdermeanor. I have court this month. My bail was set at $1000.
I am a single mom. Cant afford a attorney. In your experionce will I go to jail?

My son has a choice between the class b plus 2000 or 1yr probation plus $1400 and no conviction...problem is he doesn't think he will make a year of probation (arrested for 2 joints of pot) and doesn't think he can not smoke pot for a year...I know what I want him to do...quit smoking...how bad is the class b?21 years old until nov.20

I have a question I have a class B I got bonded out I have been to court 2 times and going back I am awaiting date its for THEFT BY CHECK MORE THAN 20 LESS THAN 500. I would really need to know how I can stay out of jail I dont have a job I have been looking, but I think it was best if I sat it out but how long will I get please I am scared out of my mind!

My husband was arrested for possession of marijuana under 2oz and drug paraphernalia. I'm told its.a class b misdemeanor and was wondering what the chargers range for this he has never had something like this before.

If I was arrested and taken to jail, fingerprinted without my lawyer present for alledgely forgedging a prescription, they let me go,i was innocent...never talked to a judge..no probation or nothing.. my layer said it would not be on my record.. is..how can i get it esponged

I was arrested for shoplifting over $50 and recieved a class b misdemeanor. I went to jail that night and posted bail the next morning when my bond was set. I've never had anything on my record until now. With this being my first offense, what type of punishment should I expect? Is there a possibilty that I will be put on probation? I have no idea how the system works, as I have never been in trouble before.

My son was picked up in El Paso with possession under 2 ounces and when he was run they found had an outstanding charge in tarrant County for the same offense. He was given 3 days in El Paso and then extradicted to Tarrant County. I need to know how much time he is looking at - he has not family of friends there so he can't do anything much other than serve his time. How long does it take before he is given a court date?

I was picked up for spray painting a fence 500 - 1500 class A criminal micsh. I have a record all misdo's and I was also charged with criminal tresspassing class B. I see that the combined time is up to 1.5 years and 6,000 dollars. I have progressed heart problems and know I will never survive jail, I will cost me a good job and insurance. How much time should I expect?

i was recently arrested for a charge on shoplifting in austin texas this is my first time offense and first time ever getting arrested and i am 18 i am in school and i am on my way to graduate i am having a lot of questions run through my mind and so many things i want to ask i really don't want this to ruin my life and future career so i t was a class b misdomenier and i really don't want this to effect what i want to do in the future just hanging out with the wrong people got me into trouble

I work in a state jail and a particular inmate has exposed himself 3 times prior to exposing himself at my picket door and starting to masturbate in front of me. I was told he was made a G-4 and could be shipped off the unit if and only if Texas Department of Criminal Justice accepts charges and pulls him off the unit....Lindsey State Jail in Jacksboro, Texas. I was informed that all he had to do was spend 90 days in segregation and then would again be put into the inmate population......each time..........I am furious as he is definitely a ped....he has to be..I would give anything to know if he is a registered sexual offender...........if not he should be made with charges to register..I am just sick about it as its been a month and they "TDCJ" just keeps leaving him in this minimum security prison.....and he does it again......If I were in the Free World and could press charges he would get 6 months in jail and I want this inmate to be getting additional time added to his sentence and all we can do as a correction officer is file a Level and Code Case for Sexual Misconduct.....why do the inmates get off easier than those in the Free World? I want answers and I want this inmate moved off of John R. Lindsey State Jail....he does not deserve a minimal security prison.......
