Definition of Homosexual Conduct - Texas Penal Code Section 21.06

§ 21.06. HOMOSEXUAL CONDUCT.

[This section was declared unconstitutional by Lawrence v. Texas, 123 S.Ct. 2472.]

(a) A person commits an offense if he engages in deviate sexual intercourse with another individual of the same sex.

(b) An offense under this section is a Class C misdemeanor.

THATS ABSOLUTELY RIDICULOUS. JUST BECAUSE SOMEBODY IS HOMOSEXUAL DOES NOT MEAN THEY ARE A CRIMINAL. THEY DO NOT DESERCE A CLASS C MISDEMEANOR, OR A MISDEMEANOR AT ALL.
