Marijuana Laws in Austin Texas

I get a lot of hits** from people who Google “Marijuana Laws Austin Texas,” or some other variation of that phrase.

I know that in Austin, we pride ourselves on being weird, but, unfortunately the marijuana laws are the same here as they are all across Texas. Perhaps people are thinking that the laws on this vary from county to county, but they don’t.

Well, sort of. Two caveats. 1, Austin supposedly will soon implement HB 2391 that allows tickets instead of arrest for pot at an officer's option. And 2, APD frequently now gives paraphernalia tickets instead of arrests for B misdemeanors as a way to reduce jail overcrowding and keep officers on the street. Both those are discretionary, though - the state law is still the same.
